Application For Conditional No Exposure Certificate
The application for Conditional Certificate of No Exposure must be completed by a person that has authority to speak on behalf of the company or municipality that owns/operates the industrial activity.
 
Facilities that receive a Conditional Certificate of No Exposure are not required to have permit coverage under the Industrial Stormwater General Permit. An industrial facility qualifies for a Conditional No Exposure Certificate when all industrial materials and activities are protected from contact with stormwater. A storm resistant shelter is the minimum level of protection required to prevent exposure to rain, snow, snowmelt, and/or runoff. It must provide protection from contact with stormwater.

Industrial materials or activities include, but are not limited to, material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities:
  • Adequately maintained vehicles used in material handling
  • Final products, other than products that would be mobilized in stormwater discharges (e.g. products such as rock salt that would dissolve or products that would corrode when exposed to stormwater).
  • Like a permit coverage, a Conditional Certificate of No Exposure is for a specific location and is not transferable to a new location or to other facilities. In addition, the exclusion from NPDES permitting is available on a facility-wide basis only, not for individual outfalls. If any industrial activities or materials are or will be exposed to precipitation (rain and/or snow), the facility is not eligible for the no exposure exclusion.
     
    By completing this application for Conditional No Exposure Certificate, the applicant certifies that a condition of no exposure exists at its facility or site, and must comply with the eligibility requirements of the Industrial Stormwater General Permit. This includes the responsibility of the applicant to:
  • reapply every 5 years
  • apply for coverage if conditions change and no exposure no longer applies
  • the right of Ecology to inspect the facility.
